We also serve Caledon clients in Hindi, Urdu, Tamil, and Tagalog. Please mention your language preference when booking your consultation. We will match you with the most appropriate team member.
My spouse and I were married in India. Can we get divorced in Canada?
Yes. If you have been ordinarily resident in Ontario for at least one year, you can file for divorce in Ontario regardless of where your marriage was registered. The resulting Ontario divorce order is recognized in most countries, though you may need additional steps to have it formally recognized in India. Our Caledon family lawyers handle international marriage divorces regularly.
My spouse has taken our children to India without my permission. What do I do?
This is a potential international child abduction matter and you should contact a lawyer immediately. India is not a signatory to the Hague Convention on international child abduction, which makes recovery more difficult but not impossible. Ontario courts can issue orders directing return and can work through diplomatic and legal channels. Time is critical . Call us today.
I just received a separation agreement from my spouse's lawyer. Do I have to sign it?
No, and you should not sign any separation agreement without first getting your own Independent Legal Advice from a separate lawyer. Signing a separation agreement without ILA puts you at significant risk. Courts can set aside agreements signed without ILA. We offer ILA review appointments at our Mississauga office, with same-week availability. We explain every provision in your language and advise you on whether the terms are fair.
Can I get a free consultation for my Caledon family law matter?
Yes. All new Caledon family law clients receive a free initial consultation. You can meet at our Mississauga office at 90 Matheson Boulevard West, by phone, or by video call. Call +1 416 333 6200 to book.
Do you serve diverse communities in Caledon?
Yes. Caledon's diverse communities have significant family law needs, particularly around parenting matters, separation agreements, and immigration-connected family issues. We have experience serving clients from these communities and can discuss the interaction between Canadian family law and legal considerations from your country of origin.
What courts handle family law in Caledon?
Family courts in Caledon handle parenting orders, child support, and divorce matters. The Ontario Court of Justice handles parenting orders, child support, and standalone family applications. The Ontario Superior Court of Justice handles divorce, property division, and equalization. Complex files often proceed in Superior Court. Your lawyer will advise on which court is appropriate for your specific matter.
