Can I get divorced in North York if I was married in another country?
Yes. If you have been ordinarily resident in Ontario for at least one year, you can file for divorce in Ontario regardless of where you were married. Ontario courts have jurisdiction over your divorce. The resulting Ontario divorce order will be recognized in most countries, though you may need to take additional steps to register it abroad.
What happens to my immigration status if I get divorced in Canada?
If your permanent residence was sponsored by your spouse, divorce does not automatically affect your PR status once it has been granted. If your PR application is still pending and you separate from your sponsor, the situation is more complex and you should speak with an immigration lawyer immediately. What is the court filing fee for a divorce in Ontario?
The Ontario Superior Court filing fee for a divorce application is currently $202 (for a single application) or $202 (for a joint application). These fees are paid to the court, not to our firm, and are in addition to our legal fees.
Can I get a divorce if my spouse refuses to sign any papers?
Yes. A divorce can be obtained without the other spouse's cooperation. If your spouse will not participate in a joint application, you can file a sole divorce application. Your spouse is served with the application and has 30 days (60 days if outside Ontario) to respond. If they do not respond, the divorce proceeds on a default basis.
How is property divided in a North York divorce?
Property division in Ontario is based on the equalization of net family property, not an equal split of assets. Each spouse's net family property (the increase in net worth during the marriage) is calculated, and the spouse with the higher NFP pays half the difference to the other. This is governed by the Ontario Family Law Act and is separate from the divorce itself.
