What should I do if I am arrested in Toronto?
Immediately invoke your right to counsel and ask to speak with a lawyer. Say nothing to police until you have consulted with us. Call Lexaltico 24/7 at +1 416 333 6200. If you cannot afford a lawyer, ask about Legal Aid Ontario. We will act immediately to protect your rights and represent you through the arrest process.
Do I need a lawyer for a criminal charge?
Yes. A criminal conviction can severely affect your employment prospects, professional licenses, immigration status, and freedom. The Criminal Code and the Canadian Charter of Rights and Freedoms guarantee you the right to legal counsel. Having experienced representation dramatically improves your outcomes, from bail hearings through trial and appeal.
What happens at a bail hearing?
A bail hearing under s. 515 of the Criminal Code determines whether you will be released while your case proceeds. The Crown must prove why you should not be released. We represent you at the hearing, present evidence, and argue for the least restrictive conditions possible. Bail conditions may include sureties, deposits, residential requirements, or no-contact orders.
What are the differences between a guilty plea and trial?
A guilty plea results in immediate conviction but allows us to negotiate sentencing with the Crown and prepare a strong mitigation brief to the judge. A trial requires the Crown to prove your guilt beyond a reasonable doubt, but if convicted, the judge sets the sentence. We advise you on the risks, benefits, and likely outcomes of each option based on the strength of the Crown's evidence.
What is a criminal record and how long does it last?
A criminal record results from a conviction and is kept on file indefinitely by the Royal Canadian Mounted Police (RCMP). It affects employment, housing, travel, professional licensing, and parental rights. For some offences, a pardon (now called a record suspension) may be available after a waiting period. Alternatively, some charges may be withdrawn or discharged, leaving no permanent record. We explore all options to minimize the long-term impact on your life.
How long do criminal cases take to resolve?
Most cases resolve within 6–18 months, though complex matters can take longer. Guilty pleas typically resolve faster than trials. Court delays and adjournments can extend timelines. During this period, we manage disclosure from the Crown, conduct legal research, explore plea negotiations, and prepare for trial if necessary. We keep you informed at each stage and explain your options throughout the process.

Criminal Charges Withdrawn Pre-Trial
All charges withdrawn after disclosure review revealed insufficient evidence
Our client faced serious charges that carried potential imprisonment. Through careful review of Crown disclosure, we identified critical inconsistencies in witness statements and gaps in the evidentiary chain. After presenting our analysis to the Crown, all charges were withdrawn before trial.
